It's pretty much everywhere where you buy the license to play the game. Real life borrowing is ok, since there is only 1 copy of the game files being shared, but on the net, all the users are getting their own copy of the game. That's one of the differences.

so you are allowed to make a backup for personal use, u make the backup and lend the game to your friend. what's the difference between this and when you copy a game to your buddy's pc?

The fact that you can't play the backup without the CD, legally.

How do you know that hundreds of people are not downloading it? Also, they aren't getting a physical copy of the game. So basically you are giving them a non-physical copy of a physical game.

i have wrote this statement which tells them not to play the game at same (it doesn't matter, they are just not allowed).

It's against the spirit of the law to copy the product. Thus loaning is can be compared to my previous example car, because two persons don't benefit from the product while producer or distributor would get only money from one.

The reason why sharing games on the internet is illegal is that, by default, you need to create a copy of your game (CD) to be able to share it on the internet. But the license explicitely tell you that you have the right to create only one single copy of the game at a time for personnal use (which basicaly mean backup. If something happen to your CD, you can still play the game with your backup then. Anybody ever owned a dog who liked to chew on CDs, raise your hand. :P)

If you make a backup of the game and you loan that backup CD to your friend, it's illegal. Even if you don't play with the real CD in that time. It's not illegal because you're loaning the game, it's illegal because the personnal copy you've made is not used for personnal use anymore.

If you make a copy of your game and you upload it on the internet to share with your friend, that's not loaning since you're not loaning anything. Not only that, but when you "share" your game on the internet you're sharing a copy other than for personnal use since you'll never use that copy, others will.

I haven't given the issue any thought, but here goes: I couldn't care less if people share illegal copies. There are no particular reason, I just don't care. Will piracy lead to no games being made at all? Don't be ridiculous. Will piracy lead to (worst case scenario) low budget game making and less or no multi million dollar budget games? No doubt. Do I care? No.
