It seems that the producer is getting cold feet, partly because of a heavy workload at school and partly because of the size of the project (as far as I can gather).
He has made a post on the AGS boards saying that he feels like stopping the project, but that he got some kind words from another member there that inspired him to keep working. Not really, no - as sprites are copyprotected by law. So it would be theft, pure and simple.
And when it comes to LucasArts, it is better to try to not step on any of their toes. They don't really approve of a lot of fan made games (and have actually shut down several projects in the past).
So by making his own sprites he is avoiding that problem, at least (although there is still the name Indiana Jones, but hopefully he'll be left alone).
And, of course, by making his own sprites he shows that he really cares about the game, and wants to do it the hard way out of love for it.

hm. but then wouldn't the IJatLC sprites be copyright too?
