Well if Bungie are letting you freely download it (the only thing that page says is that it's not open source) then it's freeware, surely?

Well, yes. I just somehow didn't like the sound of "I dunno. I just consider it legal abandonware :)". But maybe I'm just being paranoid...

Let's not forget that HotU has Ogre Battle (playstation version) and several super nintendo roms up there, which are not freeware by any stretch of the imagination. They just list whatever they can put without having legal problems.

NO. Bungie still holds the copyrights to these files. They're allowing them to be distributed for free (mostly because you can't buy them any more) - but they're still Bungie's intellectual property. You can't, for example, sell them.

Seems like the games were released as freeware, but I would really like to see an official statement from the Bungie company.

Edit:
I can't find anything stating this game as freeware. Nothing on the official game site, and nothing on the sites they are linking to.  :)

The link with the downloads above describes them as "freely downloadable but not open source," but I'm with Tom (great minds...) - an official statement of some kind would be nice. If anyone wanted to do a review and screenshots etc, they could try emailing Bungie and see what they say about the freeware status of the games.
