I don't think even with roms you'd be able to get much luck with the ESA from the stories I have read around, the companies like Nintendo, Sega are very strongly protective of their console properties just as greatly as some companies are on the pc side of the market, and again with the wii and the virtual console idea, pretty sure now the ESA will start looking more and more at the rom sites that are out there, and until it launches hard to say what will happen, but somehow don't think that now with that avenue open and the possibility of more consoles going onboard, that the argument of not being able to find so and so rom will work as much as before.

Not to say that there won't still be sites around, but think many will start to be more selective with what they decide to put on their site, least the ones that want to stick around and avoid trouble.

I hate to break it to you, but every game that isn't opensource (or free software), is in fact copyrighted for 75 years. that includes every singel game we have on Abandonia. for the companies that went defunct and weren't bought out there isn't any person to claim copyright (or press charges) but it still technicaly exists.
Now I'm not a big fan of AE (or EA :bleh: ), but I feel that if Kosta decided to go through with it we could get a few older ROMs to host from ESA (like those games we had of A... uh... AN?[ AO? or ist it just A?]).
my bet goes (and allways has) with the frewware software (more precisely the part which was created free/open), which is why I'm more often here, than on AO.

I believe that console roms/abandonware sort of fall into the same categories at least in terms of their properties and what the ESA protects, I'm not sure of a particular rule that says so and so rom has to be not sold for say 10 years. Some people in the industry say that for console roms, that the copyright lasts 75 years before they would be considered legal.

The point is that Kosta/Abandonia is "the most ligal illigal" --or something like that in Titan's words-- games download stuff on the Net. So this is most likely not going to be done by Kosta, and so hopefully nobody will do it stealing the name Abandonia. It could be done with legal roms alone, but it wouldn't be worth it, there's a ridiculous amount of them.

Does anybody know the difference between abandonware and console roms? My guess is that ALL console firms (Nintendo and Sega and) stand today, while many PC gaming firms such as Microprose don't exist any longer and so their copyrights are "abandonware" albeit legally in place. If that's the case, what about the Basic computers like Commodore, etc.?

Course there will always be something like that, someone will always do something of that nature, it's just the way life goes, but the thing is now that with the wii that there is this avenue that you can use to get games legally, I imagine the ESA will start cracking down on emulator/rom sites more and more, especially the ones that don't comply or the very least depending on company pressure as well.

Well I know they can put just about anything on a console. My cousin had his Xbox modified with an OS so he can run games from just about anything, and save them right onto his Xbox. I'm not saying it was legal, I'm just saying it could be done.
